Terms of Service

These terms govern your use of the websites, software, and services provided by CHYNJ Technologies ("CHYNJ", "we", "us"). By installing or using Kaptain, Konnect, or Konvertex, or by visiting chynj.ca, you agree to these terms.

Subject to your compliance with these terms and your payment of applicable fees, CHYNJ grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Services for your internal use.

A single-user subscription is exactly that — one user. Team and enterprise licensing is sold per seat; contact enterprise@chynj.ca for terms.

3. Free trial and subscription

Kaptain includes a 3-day free trial that starts automatically on first install. No credit card is required for the trial. After the trial, continued use of Kaptain requires an active subscription (currently CA$4.99/month). A Kaptain subscription includes free Pro access to Konnect and Konvertex for the same user.

Konnect and Konvertex are free to install and use at the Free tier without any subscription. Pro tier (CA$2.99/month standalone, or included free with Kaptain) unlocks the features listed on the respective product pages.

4. Payment, billing, cancellation, refunds

Subscriptions are billed in advance on a monthly basis through Stripe. You may cancel at any time from the Stripe customer portal; cancellation takes effect at the end of the current billing period. We do not pro-rate refunds for unused time. If you believe you've been charged in error, email billing@chynj.ca within 30 days and we'll work with you in good faith.

You own everything you create, capture, or generate with the Services — your code, your leads, your audio, your prompts. CHYNJ claims no rights to that content. Because the Services run on your own hardware, your content does not pass through CHYNJ infrastructure. See the Privacy Policy for what we do collect.

7. Third-party services and integrations

The Services may interoperate with third-party providers (e.g. Claude, OpenAI, Ollama, Microsoft Cognitive Services, Salesforce, HubSpot, Stripe, Cloudflare). Your use of those third-party services is governed by their terms, not ours. CHYNJ is not responsible for outages, charges, or behavior of third parties.

8. Updates and changes

We update the Services from time to time. We may add, modify, or remove features; we will not retroactively remove access to features that are central to the value of a paid subscription without a reasonable migration path. We may also update these terms — material changes will be communicated to subscribers by email and reflected in the "Last updated" date above.

9. Termination

You may stop using the Services and cancel your subscription at any time. We may suspend or terminate your access if you violate these terms or otherwise create risk for the Services or other users. On termination, the license grant in §2 ends; you should uninstall the Services.

10. Warranty disclaimer

The Services are provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do our best to ship reliable software but we don't promise it will always work, never lose data, or meet every requirement.

11. Limitation of liability

To the maximum extent permitted by law, CHYNJ's total liability under these terms is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.

You agree to indemnify and hold CHYNJ harmless from any claims arising from your use of the Services in violation of these terms or applicable law.

13. Governing law

These terms are governed by the laws of British Columbia, Canada. Disputes will be resolved in the courts of British Columbia, unless required otherwise by applicable consumer-protection law.
